REGULATIONS
1) Seller - Taranko Sp. z o. o. with its registered office in: 80-557 Gdańsk; ul. Marynarki Polskiej 73 B, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Gdańsk - North in Gdańsk, VII Economic Department under KRS number 0000162074, REGON 192903799, NIP 9570857274, with share capital of 100 000.00 PLN. Bank account: Bank Milleniumm - account number 97 1160 2202 0000 0002 2742 4967;
2. customer - a person who is at least 13 years of age, whereby if the person is under 18 years of age. consent of his/her statutory representative is required, unless he/she has full legal capacity, as well as a natural person who enters into a contract of sale in accordance with the terms and conditions of these Regulations as directly related to his/her business activity, when the purchase made on the basis of the contract of sale is not of a professional nature for this person, resulting in particular from the subject of his/her business activity, which is confirmed by a statement made by that person in the course of making a purchase in the TARANKO online store or Taranko Application, or a legal person, or an organizational unit without legal personality to which legal capacity is granted by law, which uses the TARANKO online store or Taranko Application, in particular which places an order in accordance with the terms and conditions of these Regulations;
3. consumer - a natural person, as well as a natural person entering into a sales contract in accordance with the terms and conditions of these Regulations as directly related to his/her business activity, when the purchase made on the basis of the sales contract is not of a professional nature for this person, resulting in particular from the subject of his/her business activity, which is confirmed by the statement made by this person when making purchases in the TARANKO online store or Taranko Application;
4. TARANKO Online Store/ TARANKO E-store/ E-store - an online store operated by the Seller and available at www.taranko.com , through which the Customer may purchase goods from the Seller;
5. Taranko Application - Taranko's mobile application through which the Customer can purchase Goods from the Seller, available on Google Play or App Store. Taranko Application is available only for purchases made in the Republic of Poland, it is not available for purchases made outside the Republic of Poland.
6. Goods - clothing, jewelry, and other accessories that are movable items, manufactured or supplied by the Seller, presented on the E-store website or in the Taranko Application, which may be the subject of a sales contract;
7. Registration Form - functionality of the TARANKO online store and Taranko Application, by means of which the Customer, providing his personal data, can create a user account, using which he can purchase goods;
8 Basket - a list of products compiled from the goods offered in the E-Store and Taranko Application based on the Customer's choices;
9. Terms and Conditions - these terms and conditions of the TARANKO Online Store and Taranko Application;
10. Conformity of the goods with the contract - conformity of the goods with the contract within the meaning of Article 43b of the Act of May 30, 2014 on consumer rights;
11. the Act - the Act of May 30, 2014 on consumer rights ( i.e. Journal of Laws of 2020, item 287 as amended);
12 . Personal Data Protection Act - the Act of May 10, 2018 on the protection of personal data ( i.e. Journal of Laws of 2019, item 1781);
13. RODO - Regulation of the European Parliament and of the Council (EU) of April 27, 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data and repealing Directive 95 / 46 / W (General Data Protection Regulation);
14. the Civil Code - the Act of April 23, 1964. Civil Code (i.e. Journal of Laws of 2022, item 1360);
15. working days - days from Monday to Friday, excluding public holidays;
I. GENERAL PROVISIONS
1 The E-shop and Taranko Application are operated by Taranko Sp. z o. o. with its registered office in 80-557 Gdańsk; ul. Marynarki Polskiej 73 B, entered in the Register of Entrepreneurs of the National Court Register kept by the District Court Gdańsk - North in Gdańsk, VII Economic Department under the KRS number 0000162074, REGON 192903799, NIP 9570857274, with a share capital of 100 000.00 PLN;
(2) These Terms and Conditions set out the rules for the use of the TARANKO E-Store or Taranko Application available at www.taranko.com and Taranko Application, conclusion of contracts for the sale of goods through the TARANKO E-Store or Taranko Application, placing orders for products available in the TARANKO E-Store or Taranko Application, delivery of ordered products to the Customer, payment by the Customer of the sale price of the products and shipping costs, the right to withdraw from the contract, submission and processing of complaints;
(3) The Regulations are addressed to all Customers of the Taranko E-Store or Application. The Customer is obliged to comply with all provisions of the Regulations. Sales are made on the basis of the version of these Regulations in force at the time of placing an order. The Customer is entitled to use the TARANKO E-Store and the Taranko Application in accordance with their intended purpose;
(4) The provisions of these Regulations are not intended to exclude or limit any of the Customer's rights under mandatory provisions of law. In the event of any inconsistency between the provisions of these Terms and Conditions and the aforementioned provisions, those provisions shall prevail, and the remaining provisions shall remain in force to the fullest extent permitted by law;
(5) The Customer may contact the Seller, in particular submit complaints, through the Customer Service Office; e-mail: [email protected] ; telephone: +48 455 450 194; fax: (58) 342 24 61, by letter to the Seller's postal address: TARANKO Sp. z o. o. 80-557 Gdańsk; ul. Marynarki Polskiej 73 B; Customer Service is open from Monday to Friday on Working Days from: 08:00 - 20:00.The cost of the call is in accordance with the operator's tariff;
(6) All information contained on the E-Store or Taranko Application website relating to products (including prices), do not constitute a commercial offer within the meaning of Article 66 of the Civil Code, but an invitation to conclude a contract as defined in Article 71 of the Civil Code;
(7) The price information provided on the E-Store or Taranko Application shall be binding from the moment the Customer receives the e-mail message referred to in the provision of item. III paragraph 11 of the Regulations containing Confirmation of acceptance of the order for execution. Product prices appearing in the TARANKO Online Store or Taranko Application are valid when placing an order via the Internet at www.taranko.com or in the Taranko Application. When making purchases in TARANKO stationary stores, the prices specified for products sold directly in TARANKO stationary stores shall apply;
(8) In each case of informing about the reduction of the price of goods, in addition to the information about the reduced price, the Seller shall also make visible the information about the lowest price of the goods, which was in effect in the period of 30 days before the introduction of the reduction. If a given commodity is offered for sale for a period of less than 30 days, the Seller shall, in addition to the information on the reduced price, also make visible the information on the lowest price of this commodity that was in effect during the period from the date of commencement of offering this commodity for sale until the date of introduction of the reduction.
(9) Photos of goods placed on the E-Store or Taranko Application are used to present the models specifically indicated on them, nevertheless they are for illustrative purposes only;
10. Customers have the opportunity to purchase Goods through the E-Store regardless of whether they have made Registration by completing the Registration Form and setting up a profile. Customers do not have the opportunity to purchase Goods through the Taranko Application without completing Registration by filling out the Registration Form and setting up a profile;
(11) A condition for the effective placement of an order is the provision of accurate address data by the Customer, indication of a telephone number or e-mail address at which contact from the Seller will be possible, and in the case of orders made in the Taranko Application it is necessary to create a profile.
II. SCOPE, TERMS AND CONDITIONS OF USING THE E-STORE
(1) As a condition for using the services of the E-Store and Taranko Application, you must read and accept these Regulations;
(2) The customer is obliged to read the Terms and Conditions before placing an order;
(3) The Seller shall provide electronic services to enable Customers to create a user account on the E-Store website at www.taranko.com and in the Taranko Application;
(4) The Service consists in enabling the Customer to use the functionality of the E-Store and Taranko Application after logging into the Customer panel. Registration of the Customer in the E-Store or Taranko Application is voluntary and free of charge.
(5) The Seller shall provide in the E-Store the possibility of placing an order without registration. The Seller does not provide the ability to place an order without registration through the Taranko Application;
(6) When registering, the Customer shall correctly fill in the fields in the Registration Form indicating: personal data; address data including delivery address and other data necessary for the execution of the order as indicated in the Form;
(7) The information provided in the Registration Form should be truthful and up-to-date. In case of providing false or outdated information, the Seller shall not be obliged to execute the Order;
(8) The Customer may terminate the User Account Services Agreement at any time, without giving any reason and without incurring any costs, by sending to the Seller via e-mail to: [email protected] a request for deletion of the User Account together with indication of the e-mail address of the Customer currently registered in the E-Store and Taranko Application;
(9) The Seller declares that in order to ensure the security of communications and data transmitted in the Taranko E-Store or Taranko Application, it takes technical and organizational measures appropriate to the degree of danger, in particular measures to prevent unauthorized persons from obtaining and modifying personal data transmitted over the Internet;
10.The customer is specifically required to:
a) Use the services offered by the Seller in a manner that does not cause disruption to the operation, functioning of the E-Store or Taranko Application, in particular by using certain software or devices,
b) Use of the services offered by the Seller in a manner consistent with the provisions of the law in force on the territory of the Republic of Poland, the provisions of the Regulations, as well as with the customs accepted in a given field,
c) Use the services offered by the Seller in a manner that is not onerous for other Customers and the Seller, with respect for their personal rights (including the right to privacy) and other rights to which they are entitled,
(d) Use any content posted within the Taranko E-Store or Application only for your own personal use;
(11) The Seller may terminate the User Account Service Agreement with 14 calendar days' notice for valid reasons, which include the Customer's use of the Taranko E-Store or Taranko Application in a manner that constitutes a breach of the obligations referred to in Section 10 above. The Seller may submit a statement of termination of the User Account Service Agreement to the Customer via e-mail to the e-mail address that is currently registered in the Taranko E-Store and Taranko Application. Termination of the User Account Service Agreement will result in the blocking and deletion of the Customer's account in the E-Store and in the Taranko Application;
12 Successful completion of the order is possible only if the Goods selected by the Customer are available in the Seller's warehouse. The Goods are available when the size selection option shows the specific sizes to be selected. The Seller will make every effort to replenish the stock of any of the Goods, including the size of the Goods, as soon as possible. Out-of-stock Goods will be removed from the Taranko E-Store or Application without delay;
(13) With respect to services provided electronically, these Regulations are the regulations referred to in Article 8 of the Act of July 18, 2002, on the provision of services by electronic means (i.e., Journal of Laws of 2019, item 123).
III. PLACING ORDERS
(1) The Customer may purchase Goods in the territory of the Republic of Poland by placing an order on www.taranko.com and through the Taranko Application; Orders for goods available in the E-Store or in the Taranko Application are placed by selecting the preferred purchase option. The order is placed by clicking the "place order and pay" button. By placing an order, the Customer confirms that he/she knows that the order entails an obligation to pay.
(2) Subject to the other provisions of these Terms and Conditions, the purchase of Goods can be made within the European Union through the website https://en.taranko.com In the case of this form of purchase, the Customer has the option to pay for the selected goods: with and through the PayPal Settlement Center or by traditional transfer to the account of Taranko sp. z o.o. with the number: 33 1160 2202 0000 0002 0158 4058, stating SWIFT CODE/BIC: BIGPLPW. Payment for the purchased Goods is made in EURO in the amount indicated in the Order Confirmation, subject to point IV paragraph 7 of the Terms and Conditions. Through the Taranko Application, the Customer is not able to make a purchase outside the territory of the Republic of Poland.
(3) A necessary element of using the E-Store or Taranko Application is the Customer's acceptance of the Terms and Conditions, which the Customer confirms by checking the appropriate box in the E-Store or Taranko Application. Failure by the Customer to accept the Terms and Conditions prevents the Customer from taking advantage of the opportunity to purchase goods in the E-Store or Taranko Application. The Customer accepts the content of the Terms and Conditions once, and a new acceptance of the Terms and Conditions will be required each time the Terms and Conditions are changed.
(4) Another element of the procedure for placing an order by the Customer is the provision by the Customer of personal data indicated when placing an order by the E-Store or Taranko Application, marked as mandatory, and the expression of consent by the Customer, by checking the appropriate box before finalizing the order, to the processing of the Customer's personal data provided when placing the order for the purpose of processing the order placed in the E-Store or Taranko Application. In each case of making a purchase within the framework of business activity (i.e. for a company), the Customer is obliged to make a statement whether the purchase made is of a professional nature for the Customer related to his/her business activity;
(5) Placing an order in the E-Store or in the Taranko Application is possible 24 hours a day, on all days of the week. Orders are fulfilled by the Seller within the period indicated in the Confirmation of Acceptance of Order for Fulfillment, and in the event that the order execution period is not indicated, within the estimated period indicated in the selection of a given delivery method, and in any case it will not be longer than 10 Business Days from the date of conclusion of the sales contract in accordance with the provision of item. V paragraph 2 of the Terms and Conditions;
6 Payment for an order by Gift Card is possible in the E-Store. In case of payment by Gift Card as a payment choice by the Customer when placing an order, the Customer is redirected to the payment on the GiftCard platform at the link: www.giftcardsystem.pl; The Seller does not provide the possibility to pay for an order made in the Taranko Application.
(7) If an order is placed on a Business Day after 2:00 p.m., Saturday, Sunday or other public holidays (Saturdays, Sundays and other holidays ), the lead time is extended by the time covering the public holidays, and the indicated lead time runs from the next Business Day after the completed public holidays;
(8) If the Customer registers a user account in the E-Store or Taranko Application, placing an order is done by logging in to the E-Store or Taranko Application using the data provided by the Customer, after selecting the color and size and adding the Goods to the shopping cart, followed by confirmation of the will to place an order with the obligation to pay; the login data in the E-Store also allows you to log in to your account in the Taranko Application.
(9) If the Customer has not registered a user account with the E-Store, the condition for placing an order is to add the goods to the shopping cart, after selecting the color and size, providing
all the required data necessary for the shipment of goods, and taking other technical actions based on the messages or information displayed to the Customer in the E-Store;
(10) Sending an order by the Customer (approval with the "place an order and pay" button) constitutes an offer made by the Customer to Taranko Sp. z o. o. to conclude a sales contract in accordance with the content of the Regulations;
(11) After sending an order in accordance with paragraph 10 above, the Customer shall receive an order confirmation ("Order Confirmation") to the e-mail address indicated by the Customer in the Registration Form or provided when placing the order. The Order Confirmation is not an acceptance of the Customer's offer, it is only a confirmation to the Customer that Taranko Sp. z o. o. has received the Customer's order. Upon receipt of the aforementioned order confirmation message, the Seller proceeds to process the Customer's order. After processing the order, the Customer receives from Taranko Sp. z o. o. a confirmation of acceptance of the order for processing, which constitutes acceptance of the Customer's offer by e-mail ("Confirmation of Acceptance of Order for Processing") to the e-mail address indicated by the Customer in the Registration Form or provided when placing the order. Upon receipt at w. of the message containing the Confirmation of Order Acceptance for Fulfillment, the contract of sale of the Goods ordered by the Customer is concluded by Taranko Sp. z o.o.'s acceptance of the offer referred to in paragraph 10 above, and the execution of the order by Taranko Sp. z o.o. begins.
12 Confirmation of acceptance of the order for execution, disclosure, recording, securing of all material provisions of the sales contract for future access to this information by the Customer shall be made:
a) Confirmation of acceptance of the order for processing in the manner indicated in paragraph 11 above, by including in the body of the e-mail sent by the E-Store or Taranko Application: information about the ordered Goods with an indication of their price, the method and cost of delivery selected by the Customer, the method and amount of payment for the entire order selected by the Customer, information about the possibility of filing a complaint together with the Complaint Form to be downloaded by the Customer, information about the right to withdraw from the contract together with the Return/Cancelation Form to be downloaded by the Customer, information about the content of the Terms and Conditions to be downloaded by the Customer,
b) attach a paper version to the completed order which will be sent to the address indicated in the Registration Form or when the Customer places the order: Order Confirmation, information on the right to withdraw from the contract, together with the Return/Withdrawal Form,
(13) The lead time indicated in the confirmation of acceptance of the order for processing is an approximate period calculated from the moment of acceptance of the order for processing until the Goods are shipped to the Customer via one of the shipping methods indicated in the body of these Regulations;
14 The customer has the right to cancel the order before receiving the Seller's Confirmation of acceptance of the order for processing. The statement of intent to cancel the order should be sent by e-mail to the Seller at the following e-mail address: [email protected];
15 Each shipment is accompanied by an order confirmation. An electronic invoice constituting proof of purchase is sent to the e-mail address provided when placing the order. If the Customer is a VAT payer and wants to receive an invoice, when placing an order he/she should select the appropriate option and provide the necessary data;
(16) The sale of Goods located in the E-Store or Taranko Application is conducted via the Internet. In order to use the E-Store or Taranko Application, including browsing the assortment and placing orders for Goods, it is necessary to:
a) a device with access to the Internet and a web browser such as Safari, Chrome, Opera, Mozilla Firefox, Internet Explorer,
(b) An active e-mail account,
IV. MAKING PAYMENTS
(1) All prices of Goods and shipping costs (delivery) are gross prices, i.e. they include taxes including VAT and are expressed in Polish zloty;
(2) The prices of the Goods on the E-Store or Taranko Application do not include the cost of delivery of the Goods;
(3) The price listed next to each item shall be binding from the moment the Customer receives the Confirmation of acceptance of the order for execution, referred to in Section III, paragraph 11 of the Terms and Conditions. III paragraph 11 of the Regulations. Information on the price of the Goods, features and essential characteristics of the Goods is available on the E-Store website or in the Taranko Application and is placed next to the presented Goods;
(4) Shipping costs shall be determined in accordance with the provisions of Section V. Fulfillment of orders and shipping costs and methods of delivery of Goods of these Regulations;
(5) Information on the total amount of order processing including the prices of the Goods and shipping costs is presented in the shopping cart after the Customer selects the Goods and delivery options and the form of payment;
6 The customer has the right to choose the method of payment for the ordered Goods:
a) cash - payment in cash on delivery to a person acting on behalf of the carrier entrusted by the Seller with the delivery of the ordered Goods - "payment on delivery",
b) bank transfer - paying for the Goods before receiving the delivery/order "pay by bank transfer". If the Customer chooses "pay by bank transfer", failure to receive payment to the account of Taranko Sp. z o. o. within 2 working days after placing the order will result in cancellation of the order. Payments by bank transfer should be made to the Seller's bank account specified in the Order Confirmation in accordance with pt. III paragraph 10 of these Terms and Conditions. The Customer is obliged to include the order number in the title of the transfer to be made. The owner of the account is Taranko Sp. z o. o. bank Milleniumm, account no: 97 1160 2202 0000 0002 2742 4967,
c) credit card or e-transfer - payment settlements are carried out by and through the Clearing Center Przelewy24 and Pay-Pal according to the rules established by the indicated entities on the websites www.przelewy24.pl and www.paypal.com,
d) Gift Card - a method of payment possible only in the E-Store, not available in the Taranko Application; after selecting this payment option, the Customer will be redirected to the GiftCard website www.gitfcardsystem.pl, where the Customer will be able to make payment for the order placed. In order to make payment by GiftCard, it is necessary to enter the 20-digit card number and the 3-digit security number next to the 20-digit number on the aforementioned page, as well as the PIN code located under the scratch pad next to the aforementioned numbers,
e) Pay - Po - payment using the consumer credits offered through the E-Store or in the Taranko Application by PayPo for Customers who are consumers and intended to finance purchases in the E-Store or in the Taranko Application. The Consumer Credit Agreement will be concluded between the Customer (as the Borrower), and PayPo (as the Lender). The consumer credit application form is available at www.paypo.pl, to which the Customer will be redirected after selecting a given form of payment for an order in the E-Store or in the Taranko Application, where the Customer submits an application for a consumer credit agreement based on the data provided from the E-Store or in the Taranko Application. The customer submits a consumer credit application for the purchase of goods of his/her choice under the terms and conditions set by the operator of this payment method, in this case PayPo. If the credit procedure is successful, Taranko Sp. z o. o. will proceed with the processing of the order and then confirm its acceptance for processing,
f) Apple Pay - payment for Customers using the IOS operating system for devices such as iPhone, iPad, Apple Watch, Mac, among others, according to the rules established at https://www.apple.com/pl/legal/privacy/data/pl/apple-pay/.
7. If, in the course of order processing by the Seller, it is found that the quantity of available goods or the order price given in the Shopping Cart at the time of placing the order by the Customer on the TARANKO Online Store or Taranko Application is the result of an error in the operation of the E-Store system or Taranko Application or any other system supporting the E-Store system or Taranko Application, The Seller shall inform the Customer of this by e-mail to the e-mail address provided by the Customer in the Registration Form or when placing the order, stating the correct quantity of available goods, price and shipping costs, and the condition of the Seller's Acceptance of the order for processing shall be the Customer's confirmation of placing the order on the terms and conditions resulting from the Seller's information. If the Customer does not confirm the placement of the order on the terms resulting from the Seller's information within 7 calendar days from the receipt of this information, the Seller shall cancel the order and refund the payments made by the Customer immediately, but no later than within 14 calendar days from the date of cancellation;
8. promotions in the TARANKO Online Store or in the Taranko App are not combinable ;
9.The total amount of order fulfillment means the amount that the customer is obliged to pay, which consists of the price of the summed items for the ordered goods and the cost of shipping;
(10) Detailed rules for the use of the Gift Card are set forth in the terms and conditions of the Gift Card, which is available on the Seller's website www.taranko.com at the link: https://taranko.com/pl/80-karty-upominkowe https://taranko.com/pl/80-karty-upominkowe.
(11) The Seller reserves the right to exclude the form of payment on delivery (cash on delivery) to a Customer who fails to collect two consecutive orders paid on delivery. Restoration of the form of making payment on delivery (cash on delivery) for a given Customer shall take place after placing and collecting another order paid in a different way than on delivery.
V. ORDER PROCESSING AND SHIPPING COSTS AND DELIVERY METHODS
(1) Upon receipt by the Seller of the confirmation of order placement by the Customer in accordance with the provision of clause III, paragraph 11 of these Terms and Conditions. III, paragraph 11 of these Terms and Conditions and the Seller's confirmation of acceptance of the order for processing, in accordance with the provision of para. III paragraph 11 of these Terms and Conditions, the Seller's order fulfillment process begins;
(2) The time limit for execution of an order, including delivery to the Client, shall be up to 10 Working Days from the date of conclusion of the sales contract for orders executed within the territory of the Republic of Poland, and shall depend, inter alia, on the method of payment and delivery chosen by the Client. The deadline indicated in the first sentence of this paragraph may be exceeded for reasons related to possible difficulties in processing the order resulting from reasons beyond the Seller's control, of which the Seller shall immediately inform the Customer in the form of an electronic message to the e-mail address indicated by the Customer when placing the order;
(3) The cost of shipping the goods shall be borne by the customer and shall be added to the price of the selected goods. The shipping cost depends on the choice of shipping method and place of delivery, in accordance with the price lists used by the carrier, which can be found at www.taranko.com in the DELIVERY tab and under the link: https://taranko.com/taranko/pl/dostawa/ or in the Taranko Application in the Customer's Account, in the Delivery and Payment tab.
(4) Goods are delivered to the address indicated by the Customer on the territory of the Republic of Poland via the Polish Post, courier companies selected by Taranko, or through other means indicated by the Seller; and to stationary stores of the TARANKO brand according to the choice of delivery method by the Customer. Orders placed with pickup at a selected Taranko brand store, must be picked up within 7 days after delivery to a Taranko brand store selected by the Customer. The Customer will be informed in an email about the fact that the shipment was delivered to the Taranko brand showroom selected by the Customer. In the event that the order is not collected from the Taranko brand showroom selected by the Customer within the period indicated above, the order will be returned to the Seller's warehouse. The Seller informs that detailed information on the form and cost of shipment of goods and approximate delivery time of shipments are provided on the E-Store website under the link: https://taranko.com/taranko/pl/dostawa/ or in the Taranko Application in the Customer's Account in the Delivery and Payment tab.
(5) In the case of delivery of the Customer's orders outside the Republic of Poland, delivery is carried out exclusively by the companies: DPD and Poczta Polska, and the expected delivery time is determined by the carrier, depending on the country of destination, and is up to 10 Business Days. This period may be subject to change due to circumstances on the part of the carrier, over which the Seller has no control. The Seller provides for the possibility of delivery of goods only to selected countries, indicated at the link: https://taranko.com/taranko/pl/dostawa/ The Seller informs that the exact shipping costs of goods outside the Republic of Poland are indicated on the website www.taranko.com at the link: https://taranko.com/taranko/pl/dostawa/ The above links can be found in the Shopping Guide/Delivery tab on the website www.taranko.com www.taranko.com.
(6) The Customer picking up the shipment with the order should immediately check the condition of the shipment: in the presence of the Courier delivering the shipment or when picking up from the parcel machine/pickup point. In the case of a damaged shipment found in the presence of the courier of the shipping company, the Customer shall deal with the damage to the shipment with the courier according to the procedures and rules of the shipping company carrying out the delivery of the Customer's order. In the event that the parcel is found to be damaged after
collection from the Courier or after collection from the pick-up/pack-up point, the Customer should immediately contact the Seller as indicated in item. I section 4 of these Terms and Conditions;
7 The maximum order processing time is 30 Working Days, after this date the Customer is entitled to cancel the order by sending a statement to the Seller via e-mail to: [email protected];
(8) Orders in the E-Store or Taranko Application are processed by the Seller in the order of receipt.
VI. THE RIGHT TO WITHDRAW FROM THE CONTRACT - RETURN
(1) The rights and obligations contained in this section of the Regulations, i.e. item VI. VI "Right of withdrawal - return" - the rights and obligations of the Customer apply only to the Customer who is a Consumer within the meaning of the Act, as well as to a natural person who concludes a sales contract in accordance with the terms of these Regulations as directly related to his/her business activity, when the purchase made on the basis of the sales contract is not of a professional nature for this person, resulting in particular from the subject of his/her business activity, which is confirmed by the statement made by this person during the purchase in the E-Store or in the Taranko Application;
2. A Customer who is a Consumer in accordance with the Act, as well as a natural person who concludes a sales agreement in accordance with the terms of these Regulations as directly related to his/her business activity, when a purchase made on the basis of a sales agreement does not have for this person a professional character, resulting in particular from the subject of his/her business activity, which is confirmed by a statement made by this person during the purchase in the E-Store or in the Taranko Application, may withdraw from the contract of sale of goods concluded through the E-Store or Taranko Application at a distance without giving any reason by making a statement to that effect in writing or by e-mail within 30 calendar days from the date of purchase of the goods, i.e. receipt of a message about confirmation of acceptance of the order for processing, after which the contract of sale of the goods ordered by the Customer is concluded. To meet the above deadline it is sufficient to send the statement of withdrawal before its expiration. A notice of the right of withdrawal is given to the customer during the ordering procedure, in addition, it can be found in the Confirmation of Acceptance of Order for Processing referred to in pt. III paragraph 11 of these Regulations and on the Return - Withdrawal Form transmitted together with the goods to the Customer;
(3) The above right may be exercised by the Customer by sending a written statement of withdrawal from the contract of sale to the address: Taranko Sp. z o. o. "E-Store" 80-557 Gdansk, 73 B Marynarki Polskiej Street or directing the statement via e-mail to: [email protected], for this purpose the Customer may use the Return - Withdrawal Form delivered to the Customer together with the goods, but this is not mandatory;
(4) The return form - withdrawal from the contract - is available on the E-Store website in the tab "Shopping Guide - Return" (download the form), which is located at the link: https://taranko.com/taranko/pl/zwrot/ or in the Taranko Application and is made available in a form that allows its downloading, recording and printing. In the case of withdrawal from the contract of sale of goods concluded at a distance, the contract is considered not concluded and the Customer is released from all obligations.
(5) In the event that the Customer submits a statement of withdrawal from the contract in a form other than written, the Seller shall immediately confirm to the Customer via e-mail address (provided when placing the order or other if provided in the submitted statement) receipt of the statement of withdrawal referred to above;
(6) The Seller shall immediately, but no later than within 14 calendar days from the date of receipt of the Customer's statement of withdrawal from the sales contract, return to the Customer the payments made by the Customer, including the costs of delivery of the goods with the exception of additional costs resulting from the method of delivery of the goods chosen by the Customer other than the cheapest ordinary method of delivery offered by the Seller in the E-Store or in the Taranko Application. The Seller shall not bear the cost of returning the goods by the Customer to the TARANKO E-Store or the Taranko Application;
7 The Seller shall refund the payment using the same method of payment used by the Customer. In case of cash on delivery payment, the Customer is obliged to provide the bank account number in the Return Form to which the payment will be refunded. In the case of payments made using the Taranko Gift Card, the refund is made only to a newly issued Taranko Gift Card for this purpose, valid for 12 months after the refund. The Taranko Gift Card issued in connection with the refund will be credited with an amount corresponding to the value taken from the Gift Card with which the customer made payment for the goods. If payment is made using the Gift Card and another payment method indicated in these Terms and Conditions, i.e. in Section IV. Paragraph 6 "Making payments" , the Seller will first refund the payment to the newly issued Taranko Gift Card for this purpose, and subsequent refunds of payments using the same method of payment used by the Customer.
(8) The Customer is obliged to return the Goods to the Seller immediately, but no later than within 14 calendar days from the date on which the Customer withdrew from the contract of sale. To meet the deadline it is sufficient to return the goods before its expiration. The Customer shall bear the cost of returning the goods to the E-Store or Taranko Application.
9 Delivery of the Goods is available in the territory of the Republic of Poland, to the extent each time indicated in the tab "Delivery & Payment" in Taranko's E-Store (available at https://taranko.com/dostawa) and Taranko Application in the Customer's Account in the tab Delivery & Payment. Delivery of the Goods to the Customer is against payment, unless otherwise stated in the sales contract. Taranko may introduce other conditions or methods of delivery, including, but not limited to, determining from what amount of the Order free delivery will be possible. The delivery costs of the Goods are indicated to the Customer in the "Delivery & Payment" tab on Taranko's website (available at https://taranko.com/dostawa) and in the Taranko Application in the Customer's Account in the Delivery & Payment tab, including at the moment when the Customer expresses his/her willingness to be bound by the sales contract - order placement is included in Part III. Regulations of the E-Store ("III. PLACING ORDERS")."
(10) If the Customer has chosen a method of delivery of goods other than the cheapest ordinary method of delivery indicated in paragraph 9 above, the Seller shall not be obliged to reimburse to the Customer the additional costs incurred by the Customer, being the difference between the cheapest method of shipment and the actual cost incurred by the Customer. Detailed shipping costs of goods outside the Republic of Poland indicated on the E-Store website in the "Shopping Guide/Delivery" tab under the link: https://taranko.com/taranko/pl/dostawa/ or in the Taranko Application in the Customer's Account in the Delivery and Payment tab.
11. the Seller declares that he is entitled to withhold reimbursement of payments received from the Customer under the contract of sale in the event of his withdrawal from the contract until he receives the goods back or until the Customer provides proof of return of the goods directed to the e-mail address: [email protected].
(12) The goods returned by the Customer should be packed in a suitable manner, ensuring no damage during transport, if possible, the goods should be packed in the original packaging. The goods should be returned with complete equipment, the original tag attached to the goods and accessories as well as documents issued at the time of sale to the

13. the Customer shall be liable for any diminution in the value of the Goods resulting from the use of the Goods beyond what is necessary to ascertain the nature, characteristics and functioning of the Goods;
(14) In accordance with Article 38 of the Law - the right of withdrawal from a contract concluded remotely is not granted to the Consumer with respect to, inter alia, contracts:
a) provision of services for which the Consumer is obliged to pay the price if the trader has fully performed the service with the express and prior consent of the Consumer, who was informed before the start of the service that after the performance of the trader will lose the right to withdraw from the contract and has accepted this,
b) in which the subject of performance is a non-refabricated good, manufactured to the Consumer's specifications or serving to meet his individualized needs,
c) in which the object of performance is goods that are perishable or have a short shelf life,
d) in which the subject of performance is goods delivered in sealed packaging, which cannot be returned after opening the packaging for health or hygiene reasons, if the packaging has been opened after delivery,
(e) in which the subject of performance are things that, after delivery, due to their nature, become inseparable from other things.
(f) provision of services for which the Consumer is obliged to pay the price, where the Consumer expressly requested the trader to come to him for repair, and the service has already been fully performed with the express and prior consent of the Consumer.
The above shall also apply to a natural person who concludes a sales contract in accordance with the terms of these Regulations as directly related to his/her business activity, when the purchase made on the basis of the sales contract is not of a professional nature for this person, arising in particular from the subject of his/her business activity, as confirmed by the statement made by this person in the course of making purchases in the E-Store or in the Taranko Application.
(15) In the case of purchasing coats in the Online Store or in the Taranko Mobile Application, for which it is possible to additionally purchase a garment cover at the promotional price of PLN 1, please note that:
· The promotional price of the garment cover applies only when purchased together with a coat – the cover is not available at this price as a separate product.
· In the event of returning a coat purchased together with a garment cover at the promotional price, the return is possible only as a set – both the coat and the cover must be returned together.
· The garment cover should be returned in an undamaged, unused condition and without any defects. If the cover is missing or returned in a condition that does not comply with the above requirements, the return of the coat will not be accepted.
VII. COMPLAINTS
1. the Seller's liability under the contract of sale to Customers who are not Consumers:
a) due to physical or legal defects of the goods under the provision of Article 558 § 1 of the Civil Code is completely excluded,
(b) the Seller's liability covers only the actual damage and is limited to the value of the order,
(c) does not apply to the acts or omissions of third parties, including suppliers, couriers or others for whose acts or omissions the Seller is not responsible,
d) in terms of benefits and burdens, together with the danger of accidental loss of or damage to the goods are transferred to the Customer who is not a Consumer, at the moment of its entrustment by the Seller to a carrier (courier company) engaged in the carriage of things of this nature, for the purpose of its delivery to the Customer who is not a Consumer. In such a case, the Seller shall not be liable for the action or omission of the carrier (courier company), in particular for
loss, loss or damage to the goods arising from the moment of acceptance of the goods for transport until their release to the Customer who is not a Consumer, as well as for the delay in transporting the shipment;
(2) The provisions contained in this section of the Regulations, i.e. sec. VII "Complaints" in paragraph 3 et seq. provisions concerning the Seller's liability for non-compliance of the goods with the contract shall apply only to a Customer who is a Consumer within the meaning of the Act, as well as to a natural person who concludes a sales contract in accordance with the terms and conditions of these Regulations as directly related to his/her business activity, when the purchase made on the basis of the sales contract is not of a professional nature for this person, resulting in particular from the subject of his/her business activity, which is confirmed by the statement made by this person during the purchase in the E-Store or in the Taranko Application. For the purposes of this clause. VII, the term "Customer" shall be understood to mean only the Consumer, as defined in this paragraph;
(3) The seller, as a vendor, shall be liable to the customer for non-compliance of the goods with the contract under the terms of the Act and other generally applicable laws;
(4) The Seller shall be liable for the lack of conformity of the Goods with the contract existing at the time of delivery and disclosed within two years from that time;
(5) The Seller shall not be liable for non-conformity of the goods with the contract if the Customer, at the latest at the time of conclusion of the contract, was expressly informed that a specific feature of the Goods deviates from the requirements of conformity with the contract and expressly and separately accepted the lack of a specific feature of the Goods.
(6) For the avoidance of doubt, it is stated that none of the provisions of these Terms and Conditions shall limit the rights of the Customer that he is entitled to under the provisions of the law in force in the territory of the Republic of Poland;
(7) Complaint should be reported by completing the "Complaint Form", available on the E-Store website in the "Shopping Guide / Complaints" tab under the link: https://taranko.com/taranko/pl/reklamacje/ and in the Taranko Application located on the customer's account in the "Returns and Complaints" tab, send back the completed form together with the advertised goods and proof of purchase (e.g. receipt or invoice) to the address: Taranko Sp. z o.o. "E-Store" 80-557 Gdansk, Marynarki Polskiej 73B Street;
(8) The Seller shall respond to the complaint submitted by the Customer within 14 calendar days from the date of receipt of the Customer's complaint, and the Seller undertakes to inform the Customer of the actions taken via email to the email indicated by the Customer;
(9) In the event that in the Complaint Form the Customer does not indicate the required information or documents necessary for the Seller to process the complaint, the Seller will ask the Customer via e-mail to promptly complete the data necessary for the complaint process;
10. the Customer, if the Goods are inconsistent with the contract, may demand repair or replacement.
11 The Seller may make an exchange when the Customer requests repair, or the Seller may make a repair when the Customer requests an exchange, if bringing the Goods into conformity with the contract in the manner chosen by the Customer is impossible or would require excessive costs for the Seller. If repair and replacement are impossible or would require excessive costs for the Seller, the Seller may refuse to bring the Goods into conformity with the contract. When assessing the excessive costs for the Seller, all circumstances of the case are taken into account, in particular the significance of the non-conformity of the Goods with the contract, the value of the Goods in conformity with the contract and the excessive inconvenience for the Customer resulting from the change in the manner of bringing the Goods into conformity with the contract.
12. the Seller shall repair or replace y the Goods within a reasonable time from the moment the Seller is informed by the Customer of the non-conformity with the contract, and without undue inconvenience to the Customer, taking into account the nature of the Goods and the purpose for which the Customer purchased them. The Seller shall bear the costs of repair or replacement, including in particular the costs of postage, transportation, labor and materials.
(13) If the Goods are inconsistent with the contract, the Customer may submit a statement of price reduction or withdrawal from the contract when:
(a) The Seller refused to bring the Goods into conformity with the contract;
(b) Seller failed to bring the Goods into conformity with the contract;
(c) the lack of conformity of the Goods with the contract continues even though the Seller has tried to bring the Goods into conformity with the contract;
(d) the lack of conformity of the Goods with the contract is so significant as to justify a reduction in price or withdrawal from the contract without first resorting to the means of protection set forth in paragraph 9;
e) it is clear from the Seller's statement or circumstances that he will not bring the Goods into conformity with the contract within a reasonable time or without undue inconvenience to the Customer.
14 The reduced price must remain in such proportion to the contract price as the value of the non-conforming Goods remains to the value of the conforming Goods.
15 The Seller shall return to the Customer the amounts due as a result of exercising the right to reduce the price immediately, no later than within 14 days from the date of receipt of the Customer's statement on price reduction.
16. the Customer may not withdraw from the contract if the lack of conformity of the Goods with the contract is insignificant.
(17) If the non-conformity with the contract applies only to some of the Goods delivered under the contract, the Customer may withdraw from the contract only with respect to those Goods, as well as with respect to other Goods purchased by the Customer together with the non-conforming Goods, if the Customer cannot reasonably be expected to agree to retain only the non-conforming Goods.
(18) In the event of withdrawal from the contract, the Customer shall immediately return the Goods to the Seller at his expense. The Seller shall return the price to the Customer immediately, no later than within 14 days from the date of receipt of the Goods or proof of their return.
19. the Seller shall refund the price using the same method of payment used by the Customer, unless the Customer has expressly agreed to a different method of refund that does not incur any costs for him.
20 The cost of delivery of the advertised Goods to the Seller, and in the case of a successful complaint, also the cost of sending the Goods to the Customer shall be borne by the Seller.
VIII. TERMS AND CONDITIONS OF PURCHASING FROM TARANKO INTERNET SHOP BY TELEPHONE AND ELECTRONIC E-MAIL (the "Rules").
(1) The rules set forth in this Section VIII. do not apply to purchases made through the Taranko Application. Customers of Taranko Sp. z o. o. have the opportunity to make purchases through the following distance sales channels:
a) via the online store form on the terms and conditions described in the TARANKO Online Store Regulations, or
(b) by telephone, via the available TARANKO telephone number + 48 455 450 194 on the terms and conditions described in the TARANKO Online Store Terms and Conditions and set forth in these Terms and Conditions, unless otherwise indicated herein, or
c) via e-mail address: [email protected] on the terms and conditions described in the TARANKO Online Store Regulations and specified in these Terms and Conditions, unless otherwise specified in these Terms and Conditions Placing orders via telephone or e-mail address:
(2) Before using the possibility of making purchases via telephone or e-mail address, the Customer shall, in any case, read the TARANKO E-shop Regulations available on the website www.taranko.com and these Rules;
3 TARANKO shall provide services in accordance with the Regulations and the Rules;
(4) In order to place an order, it is required to have an active e-mail address and telephone number. Placing an order by phone or e-mail address is tantamount to acceptance of the terms of the Regulations and Rules. If you do not accept the Terms and Conditions or the Rules, please stop the phone call or, in the case of an order placed by e-mail, the Customer should provide information regarding disagreement with the terms of the Terms and Conditions or the Rules;
(5) Telephone orders may be placed on Business Days from Monday to Friday from 8:00 am to 8:00 pm;
(6) Orders via e-mail address can be placed 24 hours a day, with confirmation and execution of orders taking place on Business Days from Monday to Friday from 8:00 - to 20:00;
(7) In order to improve the process of customer service, we ask that before making a phone call or placing an order via e-mail address, the customer should prepare or indicate in the message the reference numbers of the goods he wants to order (the number is located under the name of the goods on the card of the product in question and looks like this "Ref. No. M0SK04"). Each product has a separate reference number, the number indicated in this description is only an example;
(8) To place an order by phone, you must make a phone call to + 48 455 450 194. During the call, you will be informed of the most important rules regarding the processing of your personal data and where TARANKO will provide you with detailed information in this regard. Detailed information on the terms and conditions of TARANKO's processing of personal data can be found on the website www.taranko.com, under "Privacy Policy". In case the Customer does not consent to the processing of his/her personal data, he/she should immediately disconnect;
(9) In order to place an order via e-mail address, it is necessary to direct to the e-mail address: [email protected] information about the goods that the Customer wants to order, indicating the reference number of the goods, size and quantity and personal data indicated in paragraph 9 below;
10. personal data necessary for the execution of the order placed by phone +48 455 450 194 or e-mail address [email protected] are: the name of the Customer, the address to which the order is to be delivered, telephone number and e-mail address to which the order confirmation will be sent;
(11) During a telephone conversation with a TARANKO consultant, the Customer will be asked to select the order delivery method and the order payment method offered by TARANKO. In the case of an order placed via email, the customer should indicate the selected method of delivery and payment for the order in the order;
12. the available methods of delivery of goods are listed in the Terms and Conditions in section V.;
13. in the case of orders by phone on + 48 455 450 194 or through the e-mail address [email protected] it is possible to make payment for the order only:
a) in cash, to a person acting on behalf of the carrier entrusted by the Seller with the delivery of the ordered Goods (cash on delivery), or
b) by bank transfer before delivery (payment before shipment of the order);
(14) Upon completion of the telephone conversation at + 48 455 450 194 or after the Customer sends the order to the e-mail address [email protected], an order confirmation will be sent to the e-mail address indicated by the Customer;
(15) If the customer chooses a payment method before shipment of the order, the placed order will await payment for 24 hours and/or the order placed on the last business day before a holiday will await payment until the first business day after the holiday after TARANKO has set up the order in the system. After this time, the order will be automatically canceled. The order will be forwarded for processing and shipment within 72 hours after payment;
(16) If the customer chooses the cash on delivery payment method, the order will be transferred for processing and shipment within 72 h from the moment of placing the order;
(17) Other rules for the implementation of the order, including, in particular, on withdrawal from the contract, returns, complaints or dispute resolution are contained in the Terms and Conditions;
(18) With respect to orders placed via telephone or e-mail, these Rules together with the Regulations shall apply;
(19) Definitions contained in these Rules shall have the meaning given in the body of the Rules, unless otherwise indicated herein;
(20) With respect to services provided electronically, these Rules together with the Regulations are the regulations referred to in Article 8 of the Act of July 18, 2002 on the provision of services by electronic means (consolidated text, Journal of Laws of 2019, item 123).
IX. INFORMATION ON DISPUTE RESOLUTION
(1) The Seller informs that in the event of a dispute, in addition to the possibility of exercising the rights in court, there is the possibility of using out-of-court means of handling complaints and asserting rights;
(2) Extrajudicial means any method that allows the resolution of conflicts through the intervention of a third party, proposing or imposing a solution. Extrajudicial instruments can be established by public authorities, legal professionals, professional groups or civil society organizations (examples: consumer ombudsman, consumer organizations, arbitration court). For information on how to access the aforementioned dispute resolution modes and procedures, please visit the following link: www.uokik.gov.pl , under "Consumer Dispute Resolution";
(3) In order to familiarize yourself with the rules of access to these procedures, you should contact the relevant body and/or entity authorized to conduct out-of-court methods of handling complaints and claims;
(4) The Seller informs that w. information does not exclude or limit in any way the possibility of choice and use by the Customer of judicial or extrajudicial means of dispute resolution, or entities conducting such proceedings. The list of methods or entities indicated in the provisions above is exemplary and non-exhaustive, and does not limit or exclude any rights of the Client.
X. NEWSLETTER
(1) The Customer may agree to receive the Newsletter provided by the Seller. The Newsletter is sent via text message (SMS-Newsletter) or e-mail (E-mail-Newsletter) indicated by the Customer;
(2) The Newsletter is sent only to Customers who have ordered the Newsletter by checking the appropriate box when placing orders in the E-Store, separate for each form of Newsletter made available by the Seller, i.e. SMS-Newsletter or E-mail-Newsletter, and who have agreed to receive commercial information within the meaning of the Act of 18 July 2002 on the provision of electronic services (consolidated text of the Journal of Laws of 2024, item 1221);
(3) As part of the offered SMS Newsletter and E-mail Newsletter services, information about news and attractive offers of the Seller are sent to the phone number and e-mail address provided by the Customer, respectively. SMS-Newsletter and E-mail-Newsletter are sent free of charge;
(4) The customer may unsubscribe from the Newsletter at any time, without giving any reason and without incurring additional costs.
(5) Detailed rules for the use of the Newsletter service are contained in the Taranko Newsletter Service Regulations available at: https://taranko.com/regulamin-newslettera
XI. PROTECTION OF PERSONAL DATA
In accordance with Article 13(1) and (2) of the RODO, the Seller informs that:
(1) Customer's personal data will be processed in accordance with the Privacy Policy available at www.taranko.com under the "Privacy Policy" tab;
(2) The administrator of the Customer's personal data is Taranko Sp. z o.o. with its registered office in 80-557 Gdańsk, Marynarki Polskiej Street No. 73 B, registered in the Register of Entrepreneurs of the National Court Register kept by the District Court Gdańsk-Północ in Gdańsk, VII Economic Division of the National Court Register, under KRS number
0000162074, REGON: 192903799, NIP: 9570857274;
(3) Personal data will be processed for the purpose of processing and servicing the order placed by the Customer in the E-Store or Taranko Application , issuing a sales receipt, shipment of goods, possible return and/or complaint, as well as for the purpose of fulfilling the Seller's obligations under applicable regulations, in particular tax and accounting regulations and the investigation and defense of claims related to the execution of the order, i.e. on the basis of: Article 6(1)(b), (c) and (f) RODO;
(4) If the Client agrees to receive the Newsletter, his/her personal data, are processed for marketing purposes, based on Article 6(1)(a) RODO;
(5) Provision of personal data by the Customer to the extent necessary for the execution of the order is voluntary; however, it is a prerequisite for using the services of the E-Store or Taranko Application. Providing personal data and expressing consents related to receiving the Newsletter is completely voluntary;
(6) The Customer's personal data will be processed for the period necessary for the execution and handling of the order and the statute of limitations for claims related to it. Personal data provided by the Customer for marketing purposes (Newsletter mailing), will be processed until the Customer revokes his/her consent to the processing of personal data for this purpose;
(7) The Customer's personal data will be transferred to the following recipients: persons authorized to process personal data on the basis of an entrustment agreement concluded with the Seller (including cooperating: law firms, personnel and accounting offices, IT service providers, providers of services related to the operation of the E-Store or Taranko Application, couriers) and entities authorized under applicable laws;
(8) The customer has the right of access to the content of its data and the right to rectify, delete, limit processing, the right to data portability and the right to object. In detail, the scope of each of the above-mentioned rights and the situations in which they can be exercised are indicated in Articles 15-22 of the RODO;
9 The customer has the right to withdraw consent to the processing of personal data at any time without affecting the lawfulness of the processing carried out on the basis of consent before its withdrawal;
10. the Customer has the right to lodge a complaint to the supervisory authority - the President of the Office for Personal Data Protection when he considers that the processing of personal data concerning him violates the applicable legislation on personal data protection;
11 The Seller informs that it uses services and technologies offered by entities such as: Facebook, Microsoft, Google, which are based in the United States. The entities referred to in the preceding sentence are certified by the Privacy Shield and use the standard contractual clauses approved by the European Commission and guarantee that they will comply with the high standards of personal data protection that apply in the European Union, so the use of their services and technologies in the processing of personal data is lawful;
12 The Taranko E-Store or Taranko Application website uses "cookies" which are computer data, in particular test files. These files are stored on the final devices of the User of the E-Store or Taranko Application.
Two types of "cookies" are used:
a) session files - temporary files that are stored on the E-Store user's terminal device until the user leaves the site or shuts down the web browser,
b) permanent - are stored in the user's terminal device for the time specified in the parameters of "cookies" or until they are deleted by the user;
Cookies are used for the purpose of:
(a) service configuration,
(b) to authenticate the user on the site and ensure the user's session on the site,
(c) implementation of processes necessary for the full functionality of the website,
(d) audience analysis and research,
(e) ensure the safety and reliability of the service,
(f) implementation of marketing activities;
The E-Store website or Taranko Application uses "cookies", which collect various information that are not, in principle, personal data (they do not allow the identification of a given user). They allow the creation of profiles through which the Seller evaluates your preferences, on the basis of which notifications are sent to offer the purchase of products. However, some information, depending on its content and use, can be linked to a specific person and thus be considered personal data;
13 The Taranko E-Store or Application website uses a Marketing Automation type tool that collects user data for the website Administrator. The collection of the above data, is aimed at facilitating you to make a purchase suitable for your user profile. You should therefore bear in mind that this type of data processing carries with it an analysis of your or your customer's profile, in order to determine what your preferences are and, consequently, what products and services best suit your style, with the aim of sending you information that is suitable for you or suggesting products that we think may interest you. If you do not wish to accept cookies, you can set your browser settings to refuse them. However, please note that some features may not be available. Cookies do not store information constituting personal data of Users or Clients. Cookies placed on the user's terminal device may also be used by advertisers and partners cooperating with the Seller, in particular for the use of tools such as Google Analytics, Google AdWords, RTB House, Hotjar, Facebook;

XII. FINAL PROVISIONS
(1) Declaring individual provisions of these Regulations invalid or ineffective as provided by law shall not affect the validity or effectiveness of the remaining provisions of these Regulations. The invalid provision will be replaced by the rule that comes closest to
the purposes of the invalid provision and these Regulations as a whole;
(2) The Seller reserves the right to amend these Terms and Conditions at any time. Amendments to the Terms and Conditions are effective from the moment they are explicitly indicated and posted on the E-Store website and Taranko Application, nevertheless, the regulations contained in the Terms and Conditions previously in force apply to sales agreements concluded before the amendment of the Terms and Conditions;
(3) The current Terms and Conditions are published on the E-Store website under the "Policies" tab, and in the Taranko Application in the customer's account under the "Terms and Conditions" tab.
(4) The Seller shall not be responsible for the blocking by mail server administrators of the transmission of messages to the e-mail address indicated by the Customer, and for the deletion and blocking of e-mail messages by software installed on the computer used by the Customer;
(5) To the extent permitted by law, the Seller shall not be liable for any disruptions, including interruptions, in the operation of the TARANKO Online Store or Taranko Application caused by force majeure, unauthorized acts of third parties or incompatibility of the TARANKO Online Store or Taranko Application with the Customer's technical infrastructure.
The Regulations enter into force on: March 12, 2026.
